Do you need a lawyer or an advocate to make your will?
Not by law, because any adult of sound mind can write a will and have two witnesses sign it. An advocate is worth the fee when your will has to deal with more than a simple division.

Do you need to register a will?
Registration is optional, and it is worth doing. A registered will goes into the government’s register of wills, and after your death your family can get a copy of it from that office, signed and sealed and admissible in court as proof of what your will said.

Who can be a witness to your will?
Any two adults can witness your will, but choose people who receive nothing under it, because for some wills a gift to a witness is void.
The witnesses do not need to read the will or know what it says. Each witness signs the will in your presence, following the steps your WillJini lawyer gives you.

Are WillJini’s lawyers advocates?
Yes. WillJini’s wills are drafted by advocates, who work from Mumbai, Delhi, Noida and Bengaluru and by video or audio call anywhere in India.
What documents do I need to make a will?
You need your identity proof, the names of the people you want to leave your assets to, and the details of what you own, such as property papers, bank and investment accounts and insurance policies. On the first call, your WillJini lawyer tells you which of these your will needs.
What is the cheapest or easiest way to make a will?
Writing the will yourself on plain paper costs nothing, and the will is valid once you and two witnesses have signed it. For a guided route, WillJini’s Online Will at Rs 7,499 plus GST takes you through each question and gives you a draft to print and sign.
Is a handwritten will, or a will on plain paper, valid?
Yes. A handwritten or typed will on plain paper is valid, as long as you sign it and two witnesses attest it.
Does a will need to be notarised?
No. You and your two witnesses must sign the will, and it does not need a notary.
Can I change my will later?
Yes. You can make a new will that replaces the old one, or add a codicil, which is signed and witnessed the same way as the will.
What happens if I die without a will?
Your property goes to your legal heirs under the succession law that applies to you. A will lets you decide who receives what and who carries out your wishes.
Is a gift deed better than a will?
A gift deed, which is charged stamp duty, suits you if you want to hand over property while you are alive. A will takes effect only on your death, and until then you can change it.
Do I need a will or a family trust?
