Is a registered will more valid than an unregistered one?

Registration adds proof. The registering officer checks who you are, your will is entered in the government’s register of wills, and after your death your family can get a signed and sealed copy from that office, admissible in court as proof of what your will said. An unregistered will is valid too, once it has been signed and witnessed properly, but nothing official records that it exists.

Common questions

Is a registered will admissible in court?

Yes. The copy the registering officer gives from the register of wills is signed and sealed, and the Registration Act, 1908 makes it admissible as proof of the contents of the original will.

What documents are required for will registration?

WillJini asks for copies of your will, a doctor’s fitness certificate, and identity proof for you and both witnesses. You bring the originals to the appointment.

Can a will be registered at home?

Registration normally happens at the Sub-Registrar’s office, and the officer may come to your home only when special cause is shown.

Is stamp paper required for a will?

A will can be written on plain paper, because no stamp duty is payable on it.

Which is better, a registered will or a gift deed?

A registered will passes property only after your death and can be changed until then, whereas a gift deed transfers property while you are alive and is charged stamp duty.

I walked into their office without prior appointment and was attended by Mr.Devvrat Unadkat promptly. He explained with clarity the procedure for drafting a will and also handed over a checklist.

I was assigned a team comprising a Advocate Alpana Rathi and Sucheta Bajaj. From the first meeting with Mr.Devvrat to drafting the will through whatsapp and email by Advocate Alpana and completing the registration formalities by Ms.Sucheta everything went smoothly.
