The signing rules for a valid will, applied abroad
How each point that decides whether a will holds works when you live outside India.
| The rule | What it means for you abroad |
|---|---|
| You sign the will by hand | Sign at home or at work; you do not need to be in India |
| Two witnesses sign in your presence | Any two people who watch you sign, of any nationality |
| Witnesses need not sign together | They can sign on different days, each in front of you |
| No set form for the witnessing | No notary, apostille or consulate stamp is needed |
| Witnesses chosen with care | Best practice: two people who receive nothing under the will |

Common questions
Do my witnesses need to be Indian?
No. Any two people who see you sign can be your witnesses, wherever you live. Just avoid anyone who receives something under the will.
Does the will need a notary or an apostille?
No. Indian law asks for your signature and two witnesses, and prescribes no particular form for the witnessing.
Can I write my will without a lawyer?
Yes. Most NRIs still use one, because a mistake in a will surfaces only when the family has to rely on it.
